


a friend got arrested on a dui. she opted for the blood test. it came back with a BAC of .27.
3 weeks later before even going to court or being convicted, her lawyer told her they failed to put in a preservative in the vial before adding the blood and therefore the alcohol has duplicated itself and it now shows a .31 BAC so he is trying to get the charges dropped.
what happens in a case like this? can it be determined how fast the alcohol duplicates itself in a period of time so that they can actually tell what the BAC would have been before it started to duplicate?
hopefully i am asking the right thing i heard this from her while she was drunk so it didn't make allot of sense (you can skip the comments on what a drunk she is-we all know it already). she says her dui will be dropped. i say BS and hope it isn't. she needs to learn. and i can pretty much guarantee it was at least a .27
