Ok so a little more in depth on what happened.

I was arrested on Jan 2nd 2010. for driving under the influence of marijuana. Today, the 11th, I got a letter from the DMV with the heading of "ORDER OF SET ASIDE OR REINSTATEMENT" and then it continues to say, "After a review of the information on file, including any evidence which you may have presented, the action effective 2/1/2010, pursuant to 13388, of the vehicle code (VC) is set aside. You may: apply for a no-fee duplicate license at the nearest DMV field office."

Kinda sounds to me like they are dismissing my case and are letting me get my license back?

But then again I did call the DMV within 10 days of my arrest to schedule a hearing to keep my license so maybe the letter is just regarding that?

If there is anyone out there who knows FOR CERTAIN what this letter means, in regards to my case, wether its been dismissed or not, please let me know!

Right now it looks like California is going to legalize pot in November since polls indicated that 60% of Californians are in favor. However, anything can happen to those polls between now and November, especially once all the anti-pot commercials and advertisements spring up near voting time.

My question: How is California law enforcement going to enforce DUI when it comes to pot? I’m assuming that there will be ALOT more people driving while they’re high if legalization goes into effect. Is there any technology out there that will help law enforcement determine if someone is high while they are driving? How do you think California law enforcement should go about?

Ok, So i was driving home drunk, had marijuana in my left pocket, brass knuckles in my right. I turned down this street and was going kind of fast, i turned right and the vehicle lost control, and smashed head on head to a parked vehicle. When i exited my vehicle i was dazed at what just happened and was tackled by a pedestrial believing my intentions were to flee the scene. When officers arrived, i was charged with Driving Under the Influence(M), Carring Connceled Weapon(brass knuks.)(F), Possesion of marijuana(M), violation of probation(M). All this occered in the state of michigan in the county of macomb please help i have court tomorrow, i need assurance?!?!?!

for dui. Passenger then allows search and the cop finds marijuana in the passengers bag.. the driver is not charged for dui. Is the search then legal? is a Coersed search valid?

Mr.- you are what we call good people. Both of us know you had more than a few drinks and a little marijuana. isn"t that right? What made him think I was good people? I had never met this guy in my life.
This was my third DUI in 2 years forgot to add.

Not once in my police career did I do a DUI, go to a fight or answer a domestic violence call where MJ was the catalyst, it was always Alchohol. I got to believe Uncle Sam can’t get a piece of the pie you can grow in your yard.

they said it was a class a misdamener(howevver u spell it)i dont know anything about the law and i didnt even know she did that kind of stuff ,but i am worried and want to know how bad she can get in trouble…she will loose every thing she has if she has to stay in jail!she has 2 dogs and her house is a section 8,she is also on disability,they didnt find much…she also had 2 dui’s a long time ago…..like about 10 years ago,she lives in indiana…..what do u think they will do to her?i am worried for her!please help!!!!!

I’m 20 yrs old, I got my first DUI like a few weeks ago..I was driving while high they say..I wasn’t drunk at all but high so they say. When I took a breathalyzer it came back 0% Should this look better for me? They said they found a little under a gram of marijuana in my car..I was ticketed for missing headlight (didn’t even know, was the real reason i got pulled over, failure to yield, no insurance, no seat belt..all BS..Judge said he they wouldn’t appoint me a public defender because I wouldn’t be at risk of serving any jail time anyway..and he gave me time to find a lawyer or to defend myself..I said i would get a lawyer but I’m just wondering how much that will cost my parents..Ive heard crazy shit like ,000..Sounds utterly insane! I wasn’t even drunk…I live in Memphis, tn..Can anybody give me any ideas of how much this will cost? Because I mean if it costs even ,000 I’m just going to defend myself because that’s just ridiculous..I doubt that much worse would happen if i DID defend myself..Someone told me at the level court or something it wont go on my record or anything like that anyway so there’s no way in hell i would give an attorney that much fuckin money..Can someone help me out here
It was BS because they NEVER asked for my insurance! I had my insurance card in my freakin wallet..They just wrote a bunch of tickets
I will admit to the headlight being out but the seat belt, failure to yield, no proof of insurance are all bogus..Have you not heard of cops just writing tickets because they are assholes?

So…… my friend had a DUI jan 2nd of ’08. he had JUST finished his netcare program in Columbus, OH and had to return to see Judge Green to prove all was complete and his probation would be lifted. HOWEVER… since his PO was on vacation, the paperwork was not filed and he had to drop… he dropped dirty for marijuana. He went to court this morning for a revocation hearing (he has been going to AA **ON HIS OWN** and has been sober for 16 days) and they took him straight to jail. his remaining days in jail is 166…. will they make him stay the entire time??? and he has a home that is on chapter 13. is there anything they can do to help him… will he get out early??? he should have been off probation, providing the paperwork was filed on time. it wasnt even his fault!
HELP US PLZ!!!
