The Ca DMV came out with a new law stating that repeat DUI offenders can receive a restricted license with 90 days of their sentence served with a few other stipulations. I was convicted of my second DUI a few months before this date. I called the DMV and they said the law is non retroactive and I can not take advantage of this new law. Is there a way to go to court and see if they could change my conviction date or something so I can have this new law benefit me? You can view the stipulations of this new law on the Ca DMV website. The Vehicle code violations is 13352, it is division 6, chapter 2, Article 3 of the California Vehicle code. Thanks for any help Im really in a jam with out a license to work.

The DUI was 9 years ago and have had a clean record since.

I hear this more and more. That if you have a DUI then you can’t be police officer. It really kills me. I got a DUI when I was 20.. I’m 22 now and major in Law Enforcement. I still have about a year and a half to go. Am I a fool to think I can be a police officer with my record?

A friend was arrested for that and the officer did not adminster the breathalyzer or any other tests, like one would get for a DUI. She had to spend 2 hrs in jail, and then released. And will she have a fine and have to do community service, attend classes, or even serve more jail time? And if required by law that she should have had those tests done, will the case be dismissed ?

i live in ky and have my licensed suspended for one year for DUI(2nd). Can i get a hardship license or get a breathalyzer installed on my vehicle during the suspension?

I have an honorable military backround with 4 years in the U.S. Marine Corps. How much will this DUI affect my chances and what steps can I take to still become a law enforcement officer?

Just need to know when the law changed and if anything before that can be used against you.

My friend’s ex-wife got pulled over last week and was charged with both a DUI AND a DUI per sey.. I’m wondering the difference. I can’t ask her, since I don’t communicate with her anymore, and I have not been able to find anything on "google" or in the bowels of my local law enforcement’ websites. Knowing what "per sey" means, it seems like you can’t have both

Ok now I understand there are misdemeanors and felonies. In some states repeated DUI’s can result in felony charges. Also I’m trying to figure out the meaning of the word "crime". I sort of remember my teacher saying something about crime being a much stronger punishment than something else. Also how severe is a tort and could a DUI be considered this? Is it a misdemeanor? According to this site I found, "DUI is not a crime in New Jersey". http://www.ncsl.org/programs/lis/dui/felony.htm what exactly does this mean?

Wouldn’t it be a crime or felony if a person got injured or killed? If you look on that site, the descriptions for other states specify injury but NJ just says DUI is not a crime. Any help here would be greatly appreciated = – )
I’ve been reading stuff for an few hours (including that excerpt on how they’re prosecuted). What I’m asking is what do you classify a DUI in new jersey? I think I remember my professor saying it is a tort. Please explain how it’s a tort. And the classification change if you injuried or killed someone?
