It is possible. He will lose his license first, so you may need to think about that first. He is lucky he didn’t kill someone speeding & under the influence.
It all depends on the judge, prosecutor and your attorney. If he doesn’t (which my good friend and brother have had two also/ while on probation) he will likely be required to wear an ankle (alcohol monitoring) bracelet and or some other form of house arrest.
He has violated the terms of his probation. In California, one of the terms of probation is to "break no law". So he will probably have to serve some time.
Judges get irritated when they give you a break and you don’t seem to learn anything from it.
Maybe he needs a little time to comtemplate whether or not he has a problem with alcohol. It appears he does.
It will definitley not look good. I’m sure he had some sort of probation and could possibly go to jail for the legth of his probationary period. Good luck and tell him to get a handle on his drinking or at least stop driving!!!
WE CAN ONLY HOPE!
And then lets steralize him as we don’t need anymore stupid people
In Pennsylvania a second DUI constitutes 30 days incarceration, a year liscense suspension, a year probation , a fine between 1,500-5,000, and DUI and AA classes
HIS CONVICTION FOR "WET RECKLESS" (23103.5VC) WILL LIKELY BE VIEWED AS A PRIOR DUI, PARTICULARLY AS HE IS STILL ON PROBATION FROM THAT CONVICTION.
HE IS MOST LIKELY LOOKING AT A LONG SUSPENSION OF HIS LICENSE, A LARGE FINE, AND MAYBE EVEN A FEW DAYS IN JAIL. IT’S PRETTY WELL ALL UP TO THE JUDGE.
YOUR BOYFRIEND REALLY, REALLY NEEDS TO WISE UP FAST!!!!!
