I got a DUI in California last year and it was my first offense. I was ordered to pay fines, complete the DUI classes, go to AA, go to MADD meetings, and complete community service. I totally screwed up and forgot to do my community service by the deadline. Now I just got a letter saying that my probation was revoked and I have to go to court this month for a probation violation hearing.
Anyone know what the consequences of this could be?
Will I go to jail?
Will they give me a chance to make it up?
First, it will depend upon who is your Judge, the jurisdiction you are in and whether the DUI is your first or more. Other factors can include whether you complied in other aspects of your sentence, how egregious the facts of your underlying case are and what, if any, criminal background you have.
Second, a probation violation penalty can range from allowing you to do the sentence as originally ordered to added community service or even jail. Again, it depends on any of the factors listed above.

Assuming that you have done everything else, including paying the fine, it is unlikely that you would get time for a probation violation for not performing the community service. It will look better for you if you have signed up for your community service before your appearance date, so that you can tell the judge the date by which you expect to have it completed.
Remember that you have a right to counsel at the probation violation hearing, and that if you cannot afford counsel one will be appointed for you.
