If a person is on parole in California (Alameda County) and receives a DUI will you get jail time?

    Worst case, you could have your parole revoked. That means you go back to prison for the remainder of your sentence. This would be in addition to any penalty for the DUI.

    No, I will not get jail time for a parolee’s DUI.

    If that’s not what you meant, read on:

    In my experience, it’s very unlikely….VERY…that a parolee is going to have their parole revoked for a DUI under "normal" circumstances.

    They will get jail time for the DUI, but that’s not related to the parole issue.

    The defendant’s parole status probably will not make much difference to the sentencing on the DUI itself. He will get whatever is usual in Alameda County. This will certainly be a violation of parole, of at least two conditions: not to drink and not to violate the law. I’ll defer to mikeysco’s experience if he has found that DUIs do not lead to parole revocations despite the violation. (I work at the other end of the system.)

    BTW, trooper3 is unfamiliar with California law. If a person is on parole, there is no "remainder of the sentence" to be served (unless it was a life term). The parolee has COMPLETED his term before he is released under California’s determinate sentencing law. A violation of parole can be punished by an additional term in prison of anything up to one year, at the discretion of the Board.
