A great youngster, 22 years old, was stopped around 2 AM returning to his home in the Rancho Santa Margarita area basically for driving a beat up car at such hour and it led to his arrest for a DUI. Now he is facing the legal aspect of this situation and since resources are quite limited at this time, the question is: How can a person defend themselves if they have limited resources?
If this is a first offense, he could apply or request a deferred adjudication or a diversion, depending on what your state calls it. Basically, it is similar to probation, but not actually convicted of DUI. You don’t have to have an attorney representing you to get a "diversion". Good luck!
Why were you drinkiing?
Plead guilty and dont do it again. Learn your lesson.
Go to court and tell the truth. IF guilty, you pay the penalty. If innocent you walk.
And the answer is:
Court appointed lawyer. Same as every state in the country mate.
you have noi chance. The court appointed attorney will only try to get you to plead guilty. They are, alot of times, trying to become a DA, so they want to work for the other side. you are screwed, even if you were innocent! isn’t that terrible!
PLEASE DO SOMETHING ABOUT THIS AMERICA!!!!!
if you can, borrow money for a good lawyer. DO NOT USE COURT-APPOINTED!!!!!
do something America ?
hmmm lets look at this a minute , a great youngster ???
was out drinking , got drunk , CHOSE TO DRIVE knowing it was illegal , got caught , surely had some type of blood work done , since a field sobriety test is not amisable in court , failed the test , was charged with DUI .
a great youngster ???
what if this great youngster , had killed a innocent family on their way home , what if this great youngster , would of killed him self in a accident , what if this great youngster would of injured him self so bad in accident , that now he would be in the hospital suffering while his family prays , he makes it
yea some great youngster , pay your fine , accept responsibility and learn from it
" a great youngster"…great people do not leave their inability to operate a motor vehicle while impaired to chance. At least no one was killed. Let me guess-the Breathalyzer registered extreme?
It depends upon how knowledgeable the individual is about the Rules and Procedures of Court and how well versed the individual is about the law as relates to the charge.
Factors would be: 1.) Was there a refusal to perform field sobriety tests. 2.) Was there refusal to submit to breath intoxilyzer.
While it can be done, chances are not that good. The system is like a country club, and you are not a member.
unless you are facing at least six month in jail you will not get a lawyer
as toward how to defend? many factors did he take a breath test if so very difficult to defend, need experts to testify the machine was not set right very expensive
if he failed a field sobriety test, it will be the cops testimony and what he saw and observed
