Seven years is what you could potentially be looking at should you get arrested in Minnesota and are convicted of first degree DWI. Not only that, but you also stand to be ordered to pay a fine up to ,000 and because it's a felony, you'll lose your rights to vote and bear arms, among other rights. Needless to say, just the thought of these penalties is more than overwhelming. Contacting an attorney should be your first move and it should be done as soon as possible.

Here we'll discuss some of the nuances of Minnesota's tough DUI and DWI laws and how they can affect you should you ever find yourself being charged for breaking any of these laws. The first thing you should understand is that the terms DWI and DUI are used interchangeably due to revisions in Minnesota's laws. Driving under the influence (DUI) and driving while impaired (DWI) are essentially the same but are sometimes confusing due to those changes. Still, being charged with a DWI crime presents stiff penalties and depending on the charges, your past record and any other crimes you find yourself charged with, the repercussions can affect the rest of your life.

So What are the Laws?

Minnesota laws read that a DWI crime includes any person driving, operating or controlling a motor vehicle while under the influence of alcohol, a controlled substance, a hazardous substance or any combination of these. Further, if you're found with a blood alcohol concentration of .08 and are driving a vehicle, you will be arrested. If metabolites of a schedule I or II controlled substance is found in your body and you're operating a vehicle, you will be arrested. There are several aggravating factors that play a role in determining what those charges will ultimately include after your arrest. Some of these factors include:

- Other DUI/DWI arrests over the past decade

- Alcohol concentration of .20

- A minor under the age of 16 who is traveling with you

These are just a few factors and the fact is, the arresting officer is afforded a bit of leeway during the arrest. The penalties vary as well. Using a "tiered" approach, the laws are defined as:

Fourth Degree DWI is considered a misdemeanor and is punished by up to 90 days in jail and the potential of a ,000 fine.

Third Degree DWI is considered a gross misdemeanor and if you're convicted you face up to one year in jail with a ,000 fine.

Second Degree DWI is also considered a gross misdemeanor and its determined based on a number of factors such as those listed above.

First Degree DWI, if convicted, is a felony and punishable by up to seven years in prison and up to ,000 in fines. Again, aggravating factors play a large role in any sentence the judge imposes.

The laws relating to DUI/DWI charges in Minnesota are overwhelming and can be confusing. This only reiterates the importance of consulting an attorney as soon as you can. Drinking and driving destroys thousands of lives each year. Alcohol has a way of "sneaking up on you" sometimes and the effects of alcohol can be unpredictable. Some nights you may have two beers and feel a buzz, while other nights you're almost at ten and still feel unsatisfied.

Binge drinking is common among drinkers. It seems that most people either don't care for alcohol or like drinking alcohol TOO much, but it should not be tolerated when it claims so many innocent victims. Drinking with set limits and a sensible transportation plan is fine, but excessively drinking and driving someone off the road has become a serious social problem that must be targeted through a variety of community strategies.

The drinking and driving statistics for 2005 were astounding. Roughly 1 million people were injured in drunken driving crashes that year. The NTSHA reported that 16,885 Americans died in alcohol-related motor vehicle crashes, representing 39% of all traffic-related deaths.

Mothers Against Drunk Driving statistics show that the percentage jumped to 41% the following year. Additionally, the Department of Justice reported that another 1.4 million drivers were arrested for DUI or DWI.

In a survey done by the American Journal of Preventative Medicine, 159 million people admitted that they had been drinking and driving that year! Given these dangerous statistics, it seems that people are seriously underestimating the possible effects of alcohol on the road.

Since alcohol consumption is known to physically impair judgment in the amygdala region of the brain, obscuring danger while simultaneously exciting the "reward center," we almost can't help ourselves. Therefore, the only way to resist the urge to just get in your car and go is to plan ahead with a designated driver or alternate form of transportation, set defined time and alcohol consumption limits for ourselves and learn your personal tolerance levels.

The best way to prevent drinking and driving in general is to be a good friend. Sometimes it may seem taxing or you may feel underappreciated, but understand that a simple gesture could save a life.

You can suggest another ride home for the person who has been drinking alcohol, offer to let them stay the night at your house, offer to ride the bus with them home, or even pay for a cab to get them home safely. People who have high alcohol content might get belligerent with you or treat you like a "party crasher," but positive peer pressure is the only way we can combat bad habits and deadly behavior.

Each year, drinking and driving crashes in the United States cost about billion. Some efforts to combat drug and alcohol abuse have been successful. For example, increased police enforcement/setting up sobriety checkpoints have helped deter law breakers.

The zero tolerance law has been effective in targeting young drivers in some states. For some large festivals, a Ride Program is set up to give free (or at least affordable) transportation for attendees. Mandatory counseling for offenders is a good step toward recovery from alcoholism as well.

There are some drinking and driving prevention success stories. Over the past 20 years, alcohol-related fatal crash rates have decreased by 60% for drivers aged 16 to 17 years and 55% for drivers aged 18 to 20 years, according to the Centers for Disease Control and Prevention. To be most effective, communities are urged to implement and enforce minimum legal drinking age laws and "zero tolerance" laws for drivers under 21.

Does a DUI conviction affect ones credit?

 

I was charged dui + my insurance company doesn’t know, should I notify them for $1700 coverage for road work?

 

I was in an accident involving a highway railing but no other automobiles except my own. This was six months ago. My insurance company was not notified and as of now has no information regarding my accident or dui. I totaled my car and have gladly stopped driving as I live in a city and can bike, walk and ride public transportation. My question regards an outstanding bill I have for ,700 to the state highways for repair to the railing I hit. Should I pay out of pocket? or file an insurance claim and have it covered as part of my property damage liability? I have heard the insurance company would increase my insurance rate for 3 years, but I don't plan on having a car anyway. I could use the 00, however, I've come away clean thus far and am reluctant to bring this to my insurance company's attention if I don't have to, though it may be just a matter of time before the insurance company learns of the accident anyway. I have moved to a different state and have a different drivers license and plan on discontinuing my insurance at the end of the month when the policy runs out.

A Staggering Statistics of Teenage Drunk Driving

"One out of 10 children ages 12 and 13 uses alcohol at least once a month. In a single year, 522 children under age 14 were arrested for driving while intoxicated, (113 of them were under 10 years old). 70 percent of all teenagers drink alcohol. 60 percent of all teen deaths in car accidents are alcohol-related.

According to the National Highway Traffic Safety Administration, over 17,000 people were killed in alcohol-related traffic accidents in the United States last year, a rate of one person every 30 minutes. Even more alarmingly, almost 1/3 of the 15- to 20-year-old drivers killed in motor vehicle crashes in the U.S. had been drinking.

Statistics show that approximately 70% of all teenagers drink alcohol, including 1 out of 10 children between the ages of 12 and 13.

Safeguards against Underage Drunk Driving:

Parents and older siblings must be aware that they are role models to younger family members, and should be cognizant of what kind of examples they set in regard to both their driving and drinking habits.

Restricting access to liquor and automobiles at home may be an effective preventative measure in the short term, but it is even more advisable to confront your son(s) and/or daughter(s) about the serious risks involved with underage drinking.

Whether driving or riding as a passenger in a vehicle, always wear a seatbelt!

If you see vehicles that are speeding excessively or swerving, try to get a license plate number and call your Sheriff's Office, the local or state police.

If a person has too much to drink and insists on getting behind the wheel, do not get into the vehicle.

If you are going to an event where alcohol will be served, take public transportation like buses or taxis, if possible.

Regardless of your age, if you believe you may have a drinking problem, consult a school counselor, health professional, or an alcohol support group (for example, Alcoholics Anonymous).

In reaction to teenage drunk driving statistics, states have enacted harsher penalties to punish teens that drink and drive. Most states have adopted zero tolerance laws which make it a crime for a teenager to operate a motor vehicle under the influence of any amount of alcohol. In addition to harsh penalties for teenage drunk driving, it is also a crime in most states for a minor to drink, possess, transport, buy or even try to buy alcohol. Parents can be penalized for furnishing alcohol to minors, especially in cases where teenage drunk driving was involved.

Teenage drunk drivers also face some serious legal consequences that will harm them into their adult lives. They face revocation of their driving privileges, stiff fines, probation, alcohol education and treatment, and community service not to mention potential jail/prison time for a severe offense.
